Discretion is one’s freedom to decide in terms of what can be done in a given situation. In the criminal justice system the level of discretion is related to the amount of stress that can be gained, specifically in policing. Therefore, the reduction in discretion may increase the stress level, as the police officer may have to address every challenging situation without deciding for himself. For example, a police officer may decide not to uphold the law if he or she is already exhausted, which is lawfully wrong.
The regular patrol officers are the ones who normally arrest criminals as well as the ones who enforce the laws and regulations of the motor vehicles. On the other hand police detectives are normally assigned to specialized functions, such as criminal investigation. The specialized unit, however, are only available for those who already spent two years as patrol police officers. Normally, they are assigned in particular field, such as microscopic and chemical analysis, fingerprint and handwriting identification, and even firearms instruction.
The hiring process for police candidates includes different procedures. Primarily, the applicant will be interviewed before going to the series of process. Once done, a written examination will be conducted, and then an oral response test based on a video. Afterwards, it will be followed by physical fitness exam, drug and psychological testing, and polygraph. There will also be an oral board and finally, the medical examination. There will also be some conditions and agreements in relation to the police officer’s salary.
There are benefits in pursuing the policing field as a profession. Primarily, the police officer will obtain public support and cooperation, positive reputation due to the profession’s status. The third and one of the most important is the higher compensation.
Evidence that re unlawfully obtained may be related to Doctrine of Double effect that holds directly and intentionally harm in order to achieve positive results. Primarily, it is morally impermissible. It is important that officers are abreast of rulings in gathering evidence as they may or may not use them under the admissibility of evidence under special circumstances.
