Abstract
The paper is aimed at analyzing the criminal justice system. In this regard, the paper has examined the case of “11-CV-22122 Lawrence V. MS & RE Kesef Corporation” with respect to the concepts of prejudice along with the moral laws. The paper yields the outcomes that the court has made a viable decision entailing the criminal and moral laws that take in the biblical perspectives as well.
Introduction
The paper intends to analyze the essential components of a criminal justice system. For this purpose, the paper examines the “11-CV-22122 Lawrence V. MS & RE Kesef Corporation” case. It was trialed in the “Southern District of Florida” court during 07/09/12 – 07/11/2012 by the Patricia Seitz as the judge. The case was focused on Labor and Employment issues as the plaintiff, and the defendant had a dispute on overtime payment and minimum wages. The act of violating laws requires the implication of criminal justice system, and such criminal proceedings demand the judges and the mediators involved to abide strictly by the regulations and the biblical perspectives of justice at all the levels (Van Ness & Strong, 2013).
Proceeding
The proceeding of the case in the court was carried out in association with the teamwork of the judge, prosecutors, and defense attorneys. The case entails the violation of the Act of Fair Labor Standards by the employer MS & RE Kesef Corp. in response to the complaint filed by their employer “Duke Lawrance” (United States Courts, 2016). Throughout the trial, the prosecuting attorney strives to prove that the Plaintiff is entitled to receive his monetary compensations from the defendant. The claim of plaintiff seems to violate the Fair Labor Standards Act including the non-payment of the minimum wage to the employee, refusal to pay overtime payment, retaliation against the plaintiff, and forced to avoid legal proceedings. However, the criminal justice system requires the valid arguments before giving the final verdict. Therefore, the defense attorney was also given with the equal opportunities of proving the Plaintiff’s arguments wrong on the basis of evidence. The judge analyzed the evidence and arguments of both the attorneys and made a viable decision. It was evident that the plaintiff did not provide enough evidence that could prove his point. On the contrary, the employer or the defendant had enough proof that assisted the court in declaring the verdict in his favor.
Analysis
The Criminal Justice System entails strong union with the Biblical perspectives of the justice. It seems essential to understand the design of God for criminal investigations and decisions. It is believed that God’s response towards the man’s evil attitudes has been the best criminal justice solution. Instead of making the verdict through analyzing the current situation, evidence, and proof in this regard tend to assist the process of making a decision along with taking into account the God’s practice of combating and impeding the criminal behavior (Van Ness & Strong, 2013).
Throughout the proceeding, it is analyzed that the criminal law practices have incorporated the moral laws as well that ensures the sustainability of an impartial society in accordance with the concepts of Theology and Gospel. The biblical perspective of criminal justice requires the jurors to treat the culprit in a way that it is intended to reform the society rather than exploiting the real nature of the justice. In the case of Lawrence Vs MS & RE Kesef Corp., the plaintiff had filed the complaint based on the fake issues of payments and other compensations (United States Courts, 2016). Consequently, people who are responsible for making decisions on the wrongdoings of others strive to follow the rules of God. In this regard, the efforts of other courtroom members in terms of negotiating the facts, avoiding formalities along with the cooperative relationships assist the jurors to respond aptly towards the cases.
Nonetheless, the decision did not demoralize him as his moralities were valued. His charges against the company could have led him to face severe consequences, but the court’s consideration of moral laws along with the criminal laws facilitated both the plaintiff and the defender in a way that both of them received the justice that was free of prejudice or biases. The attribute of punishment is regarded as the intentional act of pain along with the use of oppression that makes it an inflicted violence. As a matter of fact, certain crimes in criminal justice settings demand the infliction of punishments that are intended to justify the wrongdoings of the criminals (Van Ness & Strong, 2013). However, the nature of punishment decides the soundness of collaborative impact of criminal and moral laws. Therefore, the punishments need to be socially acceptable so that the criminal justice system would attain maximum acceptance within the society.
Conclusion
The analysis of the criminal proceeding of “Lawrence Vs MS & RE Kesef Corp” case yields the conclusion that the judge has made a viable decision in favor of the defendant without demoralizing the plaintiff. Although the case was filed regarding the violation of Fair Labor Standards Act, it did not take enough time in declaring the fact that the defendant was truthful. The verdict was given against the plaintiff, but his moral values were considered while deciding his punishment. It reflects the idea that the criminal justice settings work in collaboration with the moral laws that incorporates the biblical perspectives so that the agenda of reforming the society remains in the first place.
