The scenarios presented in the article leave many unanswered questions begging for one to think critically to find possible answers. It is clear that Kelvin was a star, and lived a promising live. Above all he was generous and steady with his family, and other issues outside college. The following is inferred from the circumstances surrounding his injury.
It is a crime
I opine that Art had a predetermined undertaking to harm Kelvin. The evidence is clear from the Book and the TV interviews that Art gave before the match. In specific terms, “I’m the Last Thing You’ll See Before You Die” is a direct indication of the plan to harm Kelvin during the game. Art also mentioned felony assault that is definitely a crime in the making. Art showed no emotions after Kelvin was hurt, he stared in the sky; he was not concerned at all. He further refuses completely to apologies, even on humanitarian grounds to what he did to Kelvin. Art Never visited Kelvin either in Hospital or while at home nursing the injury. Art’s unveiling a book reflecting the activities that went on during the league boastfully confirm the plans to hurt Kelvin or his teammates. Based on these premises and the event that occurred in the pitch, it a crime that warranted suing of Art.
What makes Art not be prosecuted for his actions? The lawyers advise Kelvin not to sue anybody since it would be expensive, and may leave him bankrupt. Not suing for damages or criminal activities simply because one does not have enough money is a direct intimidation. It indicates that the lawyers agree that there are enough grounds to warrant suing but they are afraid of the cost implications of the same. Kelvins club should have taken the case on his behalf to fight for his justice. He was not representing himself but the club. Paying for his medical bills alone, even if it is for a life-time, does not give him the justice he deserves. If I were to be Kelvin, I could have pressed for justice even if it made me bankrupt. The lawyers were not giving Kelvin honest advice on the matter. For example, how could he simply be bankrupt even when his club was paying for his medical care and also giving him fifty thousand dollars for consultancy? On also wonders how the lawyer could projected the cost of the suit even before it was began. Although one would use experience, experience relies on the past but not the future. Such situations clearly show an unjust system as represented by the lawyers.
Art is inhuman
Further evident that links the plans of Art and his inhuman act includes his uncaring attitude soon after the occurrence. I know you agree with me that in normal circumstance, when player’s accidentally harm each other, there is a normal human reaction of consolation that takes place. Art in this case, did not even get moved by his actions and just stared in the sky probably saying a prayer for accomplishing his mission.
As indicated on the aftermath of the injury, Art never visited Kelvin either in hospital or at home. Such a behavior points out how inhuman Art was. His unwillingness to apologies further indicates his unremorseful character. Such is further brought out when he refuses Kelvin’s greeting, and instead slaps his hand back. Even the thunderous boos that welcomed Art on the “reunion” TV show did not move Art to think of his action as wrong doing to a human being. It could be possible that Art suffers from a psychological condition because most people under these circumstances would be remorseful, and even regretful on the trend the actions had taken.
Failure of the league organizers
The league organizers failed on their part in taking responsibility on the circumstances facing Kelvin. It is clearly indicated that even with that fatal fall of Kelvin, Arts notes that there was no call on the play. One wonders why there was no call on the play. The failure for not calling the play is on the organizers of the game. After Kelvins case, the league implemented stricter rules to curb unnecessary brutality as it was the case of Kelvin and Art. Such a measure, although helpful to future players does not bring any reprieve to Kelvin. There is no any single word from the side of the organizers on the fate of Kelvin or Art. It is expected that the organizer punish Art for his actions either by fining him, banning him from play for some time or forever, or any other necessary action. However, they let Art go free and Kelvin to his team and family for medical care and support. It is not only failure, but also immoral for the team organizer not to have taken responsibility on the events that occurred. The irresponsibility may mean that even with the stricter rules of the game may not bring the required changes that would guarantee the players safety.
