Ethical Dilemmas in Criminal Justice
Situation 1:
When it comes to understanding how and why judges think the way they do, it is important to see to it that they too are humans; and that somehow, they have the right to feel the need to be more effective in seeing how the situations affect the people involved and not themselves accordingly. Knowing what the connection of the judge is in the case and the defense team is important especially in pointing out the position of the judge in the situation that is being dealt with. Considering ethical matters surrounding the position of the judge and the condition of operation that the court is held responsible for, it is important to see through the bias attitude of the judge and how this would affect the overall decision of the court. Investigating on the matter is important. Perhaps getting attention from higher level of authorities on the matter could best be of help in relation to resolving the case.
Situation 2:
A person [young at his age] is noted to be strongly affected by the things happening to him (Hoy, 2005). It could be understood that in the case being dealt with in here, it is important to point out that the child [or the juvenile] being picked up is considered a minor and is not guilty of anything. Although he might be of a great value to the police force, getting him by force and detaining him would largely affect his being, besides the fact that it would endanger his safety. It is then important to not go against the principles of the law regarding this matter. Practical considerations of bringing this matter to higher authorities who have high concern for juvenile delinquents hence affecting the overall system of the way young adults are treated [even when they are assumed to hold important information about complicated cases treated by the office].
Situation 3:
A personal course of helping the officer see what she is going through; and giving her an idea on why her attitude hurts the position that she holds as a protector of the rights and safety of the people, would likely be the best course of response to the matter; however, this approach might be problematic in many terms. Notably, it is important to show concern for the individual, however, it is more important to show concern for the responsibility that comes along with the position held by the individual concerned. If the person would not listen, it is important to bring the situation to an authority who could deal with the matter with full secrecy and control (Lyon, 1999)]-. Notably, with this approach, it is important to make sure that the procedure of investigating on the matter would be held under full balance and control of the authorities concerned and the individuals involved in the case alone. Bringing the right people in the case would be a proper way of dealing with the challenge and perhaps putting back the officer into her right minds.
Situation 4:
Since the officer is already intoxicated, it is important to bring him immediately back to the main office (Banks). This would keep him out of danger as well as those who are in the road. While the officer might say otherwise, it is important to point out that the safety of the officer comes first as prioritized consideration during the time. Notably, it is important to understand that the officer’s capacity to decide is already grounded and his inhibition is already scanty. Bringing the matter into the attention of the higher authorities is indeed important. Reprimanding his actions would come into the picture next [after he is kept safe in the office] (Pollock). While it is expected that he would be affected by the situation, it is also important to take note of the fact that it is what is necessary to be accomplished.
Situation 5:
While time might be an issue in this case, it is important to take note of the fact that in relation to study-development assessment, keeping integrity in the field of academic accomplishments is necessary (Singer, 2000). Practically, the internet might provide a certain escape away from such responsibilities. Nevertheless, it should be realized that such option do more to hurt than help the student especially in understanding the real value of the assessment as part of the learning process that every student needs to take into account.
Given such option, the strength to avoid such temptation is important. Facing the challenge of dealing with time constraints should be viewed as an important aspect of progress as a learner. Students need to be fully aware of how learning occurs and how writing assessments are part of the whole process of studying and grasping the gist of every lesson presented to students in class. Perhaps understanding the real value of these assessments into the learning progress of the student would help well in coming up with good options of completing tasks beforehand. Scheduling activities and managing time accordingly would also help well in the process.
