Every country has different restrictions on termination. The restrictions on termination in United States and Canada vary from European countries. In Netherlands, before the company will actually fire an employee it will go through different stages and the Dismissal Authority is involved in the process. The role of the Dismissal Authority is a quasi-governmental group in position of the rights of the employees. There are agreements imposed when Dutch company fires a permanent employee without any cause; parties should agree on a voluntary severance package payment or visit the Dismissal Authority. The Dutch Cantonal Court Formula determines the severance payment appropriately; the salary, years of service, and financial health.
In Italy, the Article 18 Labor Law negatively affected the country’s economy by creating firmness in the employment market. Consequently, discourage the companies to hire, invest, and expand. In addition, Article 18 caused a two-tiered job market. The already-established employees protected by contracts, employees who cannot be fired easily, and for the unstable and temporary low-paid people. In Spain, the severance packages are high for the workers who are fired and almost a restraint for companies to even higher employees except its necessity. There are definite terms from its previous severance package allowing the workers fired regardless of 45-day compensation per year of service to a maximum of 42-month compensation. The new reform made the packages of 33-day of compensation per year employed and restricted to 24-month salary. In decision-making, companies have to consider different laws in every country as they make business. In addition, the companies should abide rules with different offices and employees. In fact, firing and replacing employees is more costly compared to keep the employees and to bring out the best of them.
According to Frank, he never experience to work in another country. However, after he read some policies, he felt that he could learn from other countries in part of Europe. The policies are great for the protection of the employee. The manner of making decisions has a great effect on its implication. Frank learned about the high unemployment after he read the some articles. The policies have limits that are good for the people in general. They are fortunate enough to have their job according to the progression of the people in the country. Frank has never been fired from a job; however, if it did happen, probably the job he had in Spain two years ago.
