Introduction
The governor of the state of Texas Rick Perry authorizes availability of the HPV vaccine that will be dispensed through the Texas Vaccines for Children program for suitable young girls up to 18 years of age. The health and Human Services Commission shall avail the vaccine to Medicaid-qualified young girls from age of 19 to 21.The rules concerning the administration of the vaccination program shall be based on the standards that the Health and Human Services Executive Commissioner uses during the admission to the sixth grade. The governor creates exclusive public awareness concerning the vaccine as he pushes the public to ensure the females within the age limit for the vaccine access it and in the right manner.
The governor of Texas State represents the executive power of the region. Therefore, his actions reflect the views and action of the executive arm of the state government. The governor is responsible for undertaking all the activities of the state government. He has been entrusted the duty of overseeing necessary programs of the government through the executive powers given to him by the constitution (Darger 01).
As the person elected by the people, he has the mandate of serving the people. He has to step on the platform and take necessary responsibility to ensure the public is in good status. As a result of the responsibility given to him as the executive representative of the government of Texas, the governor administers the vaccine without the knowledge of the legislature (Darger 01). It is a form of abuse of power since he does not consider the influence of the legislature in the land.
The constitution governing the Texas state enables the governor to undertake health programs. Therefore, the governor takes advantage of the power that the constitution gives him to serve his people he is inconsiderate of the reactions of the other arms of the government. The state is given the responsibility by the constitution to ensure the public accesses proper health services. The governor is ready to ensure the services are administered accordingly (Darger 01).
In the eyes of the executive, the other arms of the government seem inferior. The executive controls the powers of the governor through the constitution. In this case, the governor succeeds in overriding the rest of the arms of the government by showing that he can undertake decisions without their involvement. The rest of the arms are likely to develop a negative attitude towards the administration by the governor (Perry 01).
Although, there are no power gauges to determine the power bestowed on each of the arms of the government, there is the importance of remaining focused or determined on equality. However, the governor abuses his position to bestow more power on the executive in place of the legislature and the judiciary. Abuse of power in the office shows the poor state of the governance in the office, and the executive must be in a poor state of management. It would be proper if the governor involved the rest of the arms in such activities as passing sensitive programs (Perry 01).
The arms of the government work together to ensure there is proper administration and services to the people. However, that may not happen if the executive continues to undermine the rest of the arms without acknowledging the most outstanding processes to undertake (Darger 01). In the larger section, the executive ignores the role of the legislature in administration and execution of certain programs.
Effect to the legislature
Through the constitution, it is evident that the government should pass the bills with proper authorization of the legislature. The governor ignores this responsibility and goes ahead to operate on the powers bestowed to him by the executive. The action may make the legislature seem inferior and the arm may not agree future involvements with the executive (Darger 01).
The legislature is responsible for going through all the budgets necessary to endorse certain programs. The legislature is involved in drawing the budgets and proposing the necessary procedures to achieve the target. In the execution of the HPV Vaccine, there is no budget that is presented to the legislature (Perry 01). The executive denies the legislature the role, which is extremely vital to them. The governor should not authorize any program without a budget being presented to the legislator. However, he does it showing ignorance for the powers of the legislature.
It is the duty of the legislature to take part in the daily operations of the state. It means the legislature must be at the front in ensuring perfection of the state of the citizens of Texas (Darger 01). Nevertheless, the power is denied by the executive through the governor. He denies the legislature its role in the government. The move makes the legislature inferior in the eyes of the executive.
Also, there are previous considerations by the legislature that the executive ignores in the execution of the current policy. There are concerns on the increase deaths of the cervical cancer because of HPV. The concern of the legislature was the increase in cases of cervical cancer. There are approximately 9710 new cases of cervical cancer (Perry 01). It is extremely wrong for the executive to act on the matter without the knowledge of the legislature (Darger 01). The ignorance is shameful for the legislature, and it may make the arm reluctant any time it will be required to discuss such matters.
The legislature is recognized as the arm of the government responsible of making the law of the state. It means the legislature should be at the forefront in the execution of any policy that is likely to become part of the law of the state (Darger 01). Therefore, there is a need for persistent respect for the arm of the government since it controls massive processes that are key to the development of the state. However, the arm is likely to become hostile if the executive would overtake it and undertake its roles. The hostility would create a form of competition between the arms of the government rendering the entire government irresponsible.
Effect to the judiciary
The judiciary is responsible for the administration of law in the state. It ensures the laws in the state are followed accordingly. Therefore, it needs to be involved in passing and execution of certain laws (Darger 01). However, it is not the case when the governor passes a program without the assent of the judiciary. It shows ignorance for the role of the judiciary as an arm of the government (Perry 01). There is no platform to execute the necessary roles or duties of the judiciary.
The constitution presents the governor to Texas State as immune to the actions of the judiciary. The constitution recognizes him as the court of the last resort. It means he has perfect responsibility for the judiciary (Darger 01). Therefore, the judiciary would look inferior since it cannot take any action against the governor. The judiciary has no power to question the governor concerning the issue. The executive would influence the inaction of the judiciary over issues.
Conclusion
The governor ignores the roles of the judiciary and the legislature as he goes ahead to execute the HPV vaccine. He undermines the powers and responsibilities of the arms of the government and should be ready to mend the patches since they may be costly to his governance. All the arms of the government should work together to achieve the ultimate goals of the state through proper administration.
