Re: Addressing the negotiation between the Unions and the Management of Zinnia Hotel
I want to announce to you all the agreements put forth during the negotiation meeting. In proposal 1, which indicate that No subcontracting Clause, the union accepted it since it will be able to limit those proposals to subcontract out the union’s roles especially where there is a solemn business need. The union accepts the position of the management that it will not consider the conditions to the CBA, which references to the sub-leasing of the operations. The Union also accepted that a 7 calendar days advance notification will be appropriate for the management to reschedule all replacements and. On proposal 3, the Union accepted the management would provide a period of up to 12 months for all undocumented employees to correct any immigration problems as well as those workers will be responsible for the cost involved in the process.
On proposal 4, the union accepted that the company shall incorporate in the purchase agreement the fact that the contract is binding on the transferee or purchaser. On proposal 5, there would be a 2% increase on the wages; elimination of the workers paid meals and a 10 cent per hour are paid DC while on vacation. Proposal 6, employees cover a reasonable cost on the day care facility. Proposal 7, the union agreed that the vacation should remain as earlier stated under the CBA; hence there will be no adjustments made. Proposal 8, the adjustments on the health insurance, prescription drug coverage, eye care, dental coverage, and health care trust shall be adhered to as discussed. Proposal 9, the management agrees to notify in advance on either permanent or temporary shutdown. Proposal 10, the banking of the workers one week vacation shall be allowed as additional holidays.
However, there were several roadblocks, which included refraining from proposal 1untill a chance is provided in order to read the specific language proposal. Additionally, there were some disagreements on the wage increments as the union suggested a 6% wage while the management rejected a 0% increment. This continued until they reached in an agreeable 2% wage increase. There were some arguments about the day care fee, whereby the union suggested the employers should pay about 70% of the total fee while the employee wanted to negotiate a 30% reduction on the fee. This achievement was reached after a long hour of discussion between us and the management team. Another challenge was experienced when there emerged a heated discussion on the amount of cash to be deducted in order cover health insurance. An aftermath of a long time of discussion and reasoning, thereby, considering both sides needs, an agreeable decision was reached. Additionally, both team engaged themselves in a heated discussion concerning on whether to pay these workers during their additional holidays. It was decided that the employees should have one week bankable for their vacation as well as the payment should remain as stipulated in the CBA.
