Upon consideration of the facts surround the situation in the country, namely after a period of colonial rule it has gained independence, but as a result of colonial rule the existing tensions between the new nation’s three ethnic minorities were aggravated; the most effective type of constitution would most likely be one based on the U.S. Constitution. After its independence from the United Kingdom was obtained, the U.S. was not unlike the current situation in country. There were a number of independent “states” that had not lived together lived together as a nation before and had developed widely different customs, such as slavery in the south and religious revivalism in the northeast. However, after a brief period of confederation, the states decided that it would be better to form “a more perfect union” that would better balance the power, rights an authority of the states and the nations as a whole. The resulting constitution and the stability it has general brought to the U.S. government is persuasive. For instance, it could allow a reasonable power-sharing framework that provides north and south, federal and state, and city and regional representation. In addition, it could also provide from both majority rule but with guaranteed protections for minority groups built into the system. In short, by basing the new constitution on the U.S. Constitution, the already existing tensions could be put to positive use in creating political and administrative stability.
Accordingly, the new constitution should establish a federal system where power is divided between the national government which represent the whole nation and states, regions, and cities. For example, there could be sub-national governments for a northern state, a southern region, and several of the largest cities. As it the U.S. Constitution, those sub-national governments would largely be responsible for their own issues including elections, administration and other “state police powers” such as criminal laws, health and business regulations, education. That is to say the national government would be limited to those powers it was given in the constitution, while the sub-national states would have all the other powers not given to the national government. However, all state laws would have to comply with the national constitution. Moreover, those sub-national governments would be equal in terms of political status with one another. The national government, as stated would represent the nation but there would be some powers that it might share concurrently with the sub-national governments.
As under the U.S. Constitution, the national government would also consist of three branches, namely the legislature, executive, and judicial branches. The legislature would have the power to draft and enact laws, tax and spend, and control interstate and foreign commerce. It would be composed of two houses or representatives who represent their sub-national governments. The lower house membership would be based population of the sub-national state. The upper house would be composed of a set number (one or two), from each state. The executive branch would be headed by a president that would be elected by the popular vote of the whole nation. Lastly a judiciary would be staffed by judges nominated by the president and confirmed by both houses of the legislature. They would have the power to interpret the constitution and declare any state or national law illegal if it does not comply with the constitution. The national government would be responsible for the provision of security for the nation as a whole, including disputes between states. While a state could establish and maintain a civil police force, it would be prohibited from establishing and maintaining its own army or para-military organization.
Lastly, the constitution would also include a Bill of Rights like that in the U.S. Constitution that provides protection for minority groups within the nations from abuse brought on by the government or by the majority community. One of the tasks of the judiciary would be to apply the constitution and laws to ensure that minority rights are always upheld.
