Letting the employee return to work has more disadvantages than the advantages. The employee is a drunkard who has been arrested once due to alcohol issues, and now the second time he is in jail with pending cases for attempted murder. This employee has undergone rehabilitation once at the expense of the company. Allowing the employee to return to work might lead the company to incur losses in future due to the bad behavior of the employee. The fact that the employee attempted to shoot a person means that the work mates of the employee will be in fear, in case the employee returns to work. This is because, no one is sure if the employee has changed his behavior.
Allowing the employee to return to work has advantages. When the employee is allowed back, this might motivate the employee to change his motive and stop using drugs. The employee, however, has not been found guilty by the court. Terminating the job for the employee might discourage other employees in the company, leading to reduced work output. Allowing the employee return to work shows other employees that their rights are being exercised. This is because the court has not yet proven the employee guilty.
Suspending the employee with pay might make the situation of the employee worse than it was before. Suspending the employee means that the employee will have time to be free, and will receive a salary for each month. Availability of capital and being idle might motivate the employee to engage in serious crimes and drugs. The act of suspending the employee will lead to a vacuum in the location in which the employee had been assigned. This will affect the productivity of the company. Paying the employee who is not in work means that the company will incur extra costs, which might lead to loss in the company. Paying an employee who has committed a crime motivates other employees to commit similar crimes. The other employees in the company will realize that the punishment for committing such crimes is not lethal.
Through suspension, the employee will have a time to think on the disadvantages of the bad behavior and the use of drugs. Suspension might give the employee time to reform. Suspension from work is an advantage to the other persons in the company. The company deals with chemicals, and it would pose a high danger allowing such an employee to work. The drunkard employee is a threat to the lives of other workers. This is evident in his attempt of murder.
Terminating the employee from job means that the other employee will be at peace because the employee was a threat to their lives. The employee makes the company incur extra costs that can be avoided once he is out of the company. The behavior of the employee has exposed a bad picture of the company to the public. The company deals with chemicals, but its employees are drunkards. This means that the employee is capable of messing up the health of people who use the chemicals in case the chemicals are prepared wrongly.
It is against the law, to suck an employee who has not been proven guilty by the court of law. However, the employee cannot be allowed to continue working in the company, whereas he has such hazardous behaviors that are harmful to other employees in the company. The option of terminating the job for the employee does not solve the problem because the employee will do similar behaviors to other people in other companies and the society.
As the plant manager the best option to take, is to suspend the employee with pay until he is found guilty. The employee should not be terminated from job before he is proven guilty. That is according to the law. However, the employee cannot return to work because he poses a threat to the other employees working in the company. Allowing the employee back means that he might cause more disaster in the company than before. Suspension will give the employee time to reform before the court gives its judgment. If guilty, the employee should be sucked.
