The situation arises from the death of Tommy Jetson. Tommy Jetson had high blood pressure, did not exercise and was overweight. Consequently, he was warned that he has a high probability of getting a heart attack if he did not change his lifestyle which eventually happened. He suffered a cardiac arrest at the premises of Citywide Fitness Center when he went to pick his wife. An employee administered cardiopulmonary resuscitation as they waited for medical help to arrive. They did not have an automated external defibrillator (AED). Medical help arrived after 12 minutes which was too late to save his life. Citywide Fitness Center did not owe Tommy Jetson a duty of care since he was not a customer. However, it raises serious concerns for the firm.
Firstly, although Citywide Fitness Center may escape financial liability, the situation may significantly dent its reputation and market share. Clients may feel that they are not safe at the facility based on the incidence. They may prefer a facility with an AED and trained medical staff just in case need arises. Secondly, there is a rise in lifestyle diseases in the USA. An article that appeared on the Journal of Medicine & Science in Sport revealed that at least 1,000 people suffer from cardiac arrest a day and only 50 of them survive. Just like Tommy Jetson, potential candidates of heart attack are advised to change their lifestyle by eating health and exercising. Therefore, there is a high chance that a significant portion for fitness facilities members are potential candidates of heart attack creating a high risk that a heart attack incidence may be experienced at some point in time. It has been note that a the demographic profile of health club members has been changing in favor of older people above 35 years and there has been an increase of members above 55 years. These groups have a higher risk of cardiac arrests that younger adults. If it is a member at the facility, it may be difficult to escape financial liability if proper actions are not taken to save the life of the victim. Lastly, the mission statement of clearly states that Citywide Fitness Center seeks to provide a safe environment for its members through medical assistance in case of medical emergencies.
There are two main issues that need to be addressed. The first issue is the lack of an AED equipment. The equipment is meant to provide defibrillation for cardiac arrest cases. The American Heart Association argues that if defibrillation is provided before the lapse of one minute of the cardiac arrest will save 90 percent of its cardiac arrest victims. However, if it is provided after ten minutes, the victim has only a 2 percent chance of surviving. Therefore, the firm needs to have an AED to provide immediate defibrillation to increase the survival chances. The second issue is medical training to identify cases of cardiac arrests and how to use the AED. The AED is not always effective. There is need for information on alternatives that maybe more effective compared to the AED. There is also need for information on equipment that can be used to augment the AED to increase its efficiency.
The use of an AED can save 80 percent of patients who would die without it. Therefore, its use can save an additional 56 victims. However, improper use would kill 3 percent of people who would have otherwise survived. Therefore, it will kill one patient. Therefore, the patients that can survive out of 100 patients will be 85 patients.
