Section 1983 is a valuable tool to prove right the constitutional rights in the land. This is based on the fact that it is constructed to promote its main remedial purposes. The civil rights lawsuit is very important in the perspective that it is one of the crucial methods that hold people acting in a governmental capacity or the government accountable for their actions in the court of law.
One of the advantages of section 1983 of Title 42 of the U.S Code is that it eliminates favoritism and discrimination regardless of the position held. If the government or government agent violates the constitutional right of another person then they are held responsible for their actions. In addition, it also ensures that every individual delivers its duties perfectly. This is based on the fact that vicarious liability is provided in the statute (Forst & Dempsey, 2011). This implies that every supervisor, trainer, commander, or government agent who can be proved that they provided inadequate supervision or training is actually held liable for all the actions of the defendant. The government can be sued for damages caused to an individual based on the statue. It is evident that Section 1983 provides all the possible remedies for deprivation of freedom and rights as stated by the federal law or the constitution.
One of the disadvantages is that the section seems to be straightforward, but in the real sense it is complicated. Most of the doctrines in the section are much technical. One of the examples is that the Supreme Court created various immunities, which protect local government officials and individual state against liability on different circumstances (Forst & Dempsey, 2011). Such immunities put the entire section at risk, since most individual state and government official, may take the advantage to violate people rights.
