If I were Jackman’s manager, I do not think I would have reacted in the same way unless there were multiple complaints from customers and even then I believe I would have discussed it with Jackman first prior to sending him home. It does sound as though Jackman’s manager overreacted in this situation because, while the kufi is not mandatory, Jackman wants to wear it as a part of his religious observance while also providing for his family. While it is in violation of the organization’s dress code, because it is a part of religious observance, if nobody on his bus route had an issue with the garment, I would not see a problem with an employee maintaining such an observance undisturbed as long as he did not bother passengers.
As a customer on the bus, religious attire is obviously noticeable on employees. However, it is not uncommon. Would we ask a Christian to take off all paraphernalia dealing with the crucifix, such as a cross necklace? Oftentimes we do not. In many cases, I would not even notice a necklace such as this because they are so commonplace. As a passenger, I also would not notice Christian paraphernalia on an employee based on the political climate. We are inclined to enforce these stipulations on some more than others because there are certain ideas that come with a kufi, and other objects that represent the Muslim religion that do not surround the Christian religion. A kufi may make some passengers uncomfortable. I am not one such passenger, personally. Religious attire evident on employees does not bother me; they are observing their religion amongst themselves and while this aspect is public, the public representation by no means threatens my own beliefs unless I am so insecure in my own beliefs that the presence of the kufi is enough to suggest conversion. Unless the employee physically approaches me and verbally tries to convert me, all religious attire is okay with me as a customer on the bus.
This situation might have been avoided through better communication. Jackman’s manager could have asked if Jackman would be willing to not wear his kufi to work, or a different compromise could have been reached. Perhaps there would be a rule in the organization’s dress code that allowed for religious expression. Though it would have been extensive, the bus line also could have taken a basic poll of its passengers, asking if any were offended by Mr. Jackman’s kufi. Or, in order to maintain anonymity, they could have simply asked if passengers on the bus were offended by a bus employee’s religious attire of any kind in an effort to amend the organization’s dress code. The employee has a responsibility to respect the management’s rules and, at the time, the kufi is against the dress code, though this can be changed. It does not have to, however, because wearing the kufi is not a mandatory practice for Muslims. Management has a responsibility to make sure customers feel safe and comfortable, but they also have a responsibility to ensure the company is allowing each employee the freedom of religious expression, based on the country’s law or the organization’s rules. The organization’s dress code can change based on the aforementioned steps, but does not have to in order to ensure Jackman has the unmitigated right to wear a voluntary piece of religious attire.
