A threat is an act where the speaker makes a statement that communicates a serious expression of intent; this enables him to commit a violent, unlawful act to a group of people or just an individual. Due to violence in schools within the teenagers, there are laws that were made in the supreme courts. The court said that threats were not true if delivered in a protected speech. Once such cases are submitted to the court it judges based on the vantage point of both the speaker and the recipient. In student cases, they use the method of the reasonable person among them. If the reasonable person perceives the act as a threat, then it is considered a threat.
The most engaging topic in the reading was the threat assessment. This is a strenuous and brain engaging activity. This process begins with determining if the statement made was a threat or not. This process may involve many people’s opinions. An example is when a reasonable person considers a statement not a threat those that were involved may be called to explain the situation. A disciplinary action may afterwards be contracted to address the behavior. The main aim with threat assessment is to know if the student posed the threat or if the student made the threat. This is because threats should never be taken lightly. Nevertheless; threats may not be created equal. Though threat assessment is difficult, it is a very important process in balancing school safety and the legal rights of the students.
The paper provided a clear understanding of change in the writer’s attitude. Individuals should take keen of the words they utter and especially when angry. Threats are considered very offensive by the law and have severe punishments along them. Threats are measured by situations and ways the words were uttered. Individuals that are said to have much reasoning are the determiners of what said were a threat or not. Therefore, individuals should be keen and should measure the strength of their words before they make any statements. On the other hand, one would make a threat to protect him from danger. It is important that once one has made a threat and later submitted to the authority he or should have a reasonable act to his act.
It is possible that the various conflicts in school, results in violent since the student lack an adult to confide in. Therefore, the school should have at least a student friendly person. This will reduce the rate of violence among teenagers in school. The reasonable person uses violence stem of the involved people to make the final decision of the statement was a threat should always define the threat, violence from the interaction between the two involved. He or she should always use other predictor that might have caused the disruption too. This will result to fair judgment.
The paper proposed an area for further investigation. This is to find out the measures to be taken after a threat is identified. These are the kind and type of punishment to be administered to the wrongdoers. Threat creates different impact on individuals and therefore their punishment should not be equal too. Therefore, there is need to investigate the different methods of submitting punishments and if the punishment are good enough to create a regretful attitude to the wrongdoer. The method for the investigation should be interviewing different people to get different opinions and use of the questionnaire question. All the results should later be analyzed and a permanent conclusion made.
The paper provided an insightful question connected to the topic for further discussion. I would urge my fellow classmates to discuss this question, is threat a tort? Explain your answer?
