1. The nation that has a Constitution will be more conservatively maintained with stability and expectations. The Constitution offers rules and laws that the people must follow, and it also allowed society to be protected. The protection the Constitution gives the citizens of the nation will ensure adequate rights and reprimand illegal violation of rights. The written document has guidelines that are expected to be followed properly for every person in the nation. There is no discrimination against anyone who is expected to uphold the rights of the Constitution. The rules are for every citizen no matter what their profession may be.
The Constitution offers a narrative structure for law enforcement to follow concerning the proper ways to not violate an individual’s rights. “The guidelines that are in our Constitution are used in all legal cases, and the criminal justice system” . When these laws are questioned or not followed properly it could harm an innocent person. The reason for the documents is to ensure the nation will run properly and productively. The established Constitution was set in place at a time when the nation needed structure and clarity to obtain fair and just regulations. The citizens of the country are to carry out the rules and utilize them effectively. When an issue is brought to the court’s attention the higher court will review the Constitution and interpret the meaning to better conclude an outcome to a case. The main benefits the Constitution provides is the rights to proper legal trials, freedom of speech, protection against unlawful search and seizure, a right to dual process, a right to a speedy trial, and many more benefits that accompany the document.
2. The Constitution was written many centuries ago and had was set in stone for the future. The laws and rules that are expected to be continuously followed had not been completely examined across all scenarios. There are times that the thoughts and outcomes of the Constitution does not fit exactly into context when determining certain court cases. The Constitution will need to be examined and interpreted to understand the full potential of the guidelines and then implement them into the verdict of the case. It is best for everyone to thoroughly understand the document and be able to use it in a positive manner. Law enforcement especially needs to know this document and the meaning of each part of the Constitution. The officers should be aware that it is easy to overlook or misinterpret the meaning of the words. This would lead to violating someone’s rights and possibly criminal act for any legal professional who had done this. The disadvantages have been found to be due to the language and formation the document was constructed. Since the document had been created many years ago, it is not updated or revised to fit the everyday needs of the country. The description of the rules in the Constitution is not exactly explained and related to different scenarios in this day and age. In cases that involve an unclear meaning or interpretation of the document, it is to be analyzed and examined to benefit the accurate definition.
3. The threats of a nation that does not have a Constitution can be devastating. The laws and rules that are needed will not be written in a format that allows everyone to understand them. The countries or nations who do not use a Constitution may have very little structure, stability, and equality. The justice system in that nation will be harder to analyze when questions arise as to what should occur and the proper procedure is needed to follow. “Some of the nations that do not have a documented Constitution are; United Kingdom, New Zealand, and Israel” . These three countries are without any documented Constitution to follow and use as a guide for laws and protection. The people who live in the nations without a Constitution will not have the protection of rights in the legal and criminal justice system. The laws that are made in these countries can affect people who may not even know what those laws are defined. This can impact the citizens’ freedom and protection against violation and victimization of their nation. They will have an improper treatment that might be considered illegal in countries with a Constitution.
