Musacchio vs. the United States (1) describes the case as a certiorari to the US Court of Appeals for the Fifth Circuit. The defendant seem unsatisfied with the lower court decisions requesting its further hearing in the Fifth Circuit referred to as the federal appellate court, as suggested by United States Court of Appeals for the Fifth Circuit (n.pag.). Appellate jurisdiction and appeal were two ways for a case to get to the Supreme Court (Elizabethtown Area School District 4). Obviously, Musacchio was left unhappy with the lower court decision appealing for its review at the Fifth Circuit authorized to change the previously made decisions. According to Musacchio vs. the United States (1), the petitioner had charges brought against him for an unauthorized access of the computer system of the ex-employer, Exel Transportation Services. USHistory.org. (n.pag.) suggests that the Supreme Court tends to consider no other cases other than those with far-reaching implications beyond the two parties of the dispute. The case in question may be said to be an important precedent, upon which to build judgements in the time to come. Stated otherwise, it concerns plenty of other companies storing important information in databases that may encounter similar breaches.
Thompson Reuters (n.pag.) notes that the case will not be heard by the Court until considered important, as is the case with social issues or political matters in the run-up to elections. Acker (n.pag.) quotes Musacchio’s Attorney Jody Rudman as having emphasized the importance of the resolution of the law-of-the-case doctrine to criminal defendants. The former CEO has it in plans to overturn the Fifth Circuit decision claiming prosecutors to have had enough evidence to condemn Musacchio contrary to incorrect jury instructions (Acker n.pag.). The legal battle is a chance for the Supreme Court to retain the legitimacy and reputation of the judicial system instead of allowing it to stay under the fire of the attorney. Beyond that, cyber security is central to the business development of the country. For the court to prove the Musacchio guilty will reinforce the impression of security; thus, foreign investors or companies will be unlikely to fear lest delicate data be in peril in the USA that punishes system hacking as a deterrent measure.
