a. What is the purpose of OH& S act?
The purpose of the act is to certify that areas of work and practices in the workplaces are safe for everyone. In the act there are specified laws that affect major work places, activities, and usage of plant and substances in Australia. It aims at protecting everyone’s health and safety at the workplace by reducing the risk of death, injury, or illness.
b. Difference between an Act and a Regulation
An act is a law that has been debated upon and passed through parliament by the legislative arm of government. A regulation on the other hand is a new law that has been approved by a group of people based on an existing act passed by parliament.
c. What will a person be required to do if they fail to comply with a Code of Practice?
A failure to comply with the codes will require that the infringing party shows a legal requirement of the act has been met in an alternative method.
They cannot be prosecuted by simply not following the approved code of practice but in legal proceedings the infringement can be used as evidence that code of practice laws were not followed.
d. Name one of the requirements to form a workplace committee?
It is required that a workplace committee is a must if the employer has at least twenty employees and the majority request for the committee to be formed or if the work cover directs it so.
e. Name and describe the three types of notices that a Work Cover Inspector can issue
The notices include: a prohibition notice which prevents procedures that go against the act to be carried on; improvement notice that states that certain actions and areas need to be improved on in order the safety and health of personnel is protected properly, and the provisional improvement notice that shows directions on how to remedy an alleged non-compliance.
SECTION 3
List 4 major functions of OH&S workplace committee.
- Continue to review health and safety measures taken so that the highest standards are maintained
- Investigate matters in the workplace that might pose as risks to health and safety.
- Attempt to resolve risk and hazard matters, and if not, then they request for an investigation by the inspector.
- Ensuring health and safety representatives are elected and trained.

b. Obligations of the following stating their relevant sections under the OH&S Act 2000
Supplier: Have an obligation to make sure that products they supply are not hazardous to health and safety if used in accordance to instructions, and to educate on correct usage and possible risks associated with the product in the work site. The supplier is under the section of Manual handling in the OH& S Act of 2000.
Employer: They have an obligation to make certain that all sound and practical procedures have been undertaken to manage hazards against all possible injuries arising from the workplace. They are under the section of administration in the OH & S Act of 2000.
Employee: They have an obligation of overseeing the health and safety of others and cooperate with employers on the same matters of health and safety. They are incorporated in two sections which are the first aid and notification of accidents in the OH& S Act of 2000.
