I, SUSIE SMARTLUCK, resident and domiciled in Leesburg Town, Commonwealth of Virginia, and being of sound mind declare this is my Last Will and Testament, hereby expressly revoking all Wills and Codicils previously made by me. I am currently married to John Smartluck and having two children: Fredrick Smartluck and Samuel Smartluck.
I appoint my husband, John Smartluck, as Executor of this Will and Testament. If my husband is unable or unwilling to serve then I appoint my eldest child, Fredrick Smartluck as my alternate Executor. In the event that I die as the parent of children under the age of 18, I appoint my husband, John Smartluck, to act as their Guardian and Trustee of any trust created under the will for the benefit of such minor children.
In addition to the powers of fiduciaries now or hereafter granted by law, every fiduciary serving hereunder shall have all of the powers listed in Section 64.1-57 of the Code of Virginia. All of these powers are hereby incorporated and made a part of this instrument as it is written on the date of my death.
I will give and bequeath unto the persons named below, if he or she survives me, the property described: John Smartluck: I give cash to the sum of $ 10,000. Fredrick Smartluck: I give cash to the sum of $ 30,000. Samuel Smartluck: I give cash to the sum of $ 30,000. All of the rest, residue, and remainder of my estate, of whatever kind and character, and wherever located, shall be divided equally among my current and future children.
Upon my death the following should be notified: John Smartluck, my husband, Fredrick Smartluck and Samuel Smartluck, both my children, all of address 3654 Leesburg, Commonwealth of Virginia. Mr. Donald Freeman, my Attorney, working in the law firm of Freeman & Martha Law Office, of address 82518, Leesburg, Commonwealth of Virginia. Mrs. Chelsea Shaw, my accountant, working in the firm of TPM Accountants, of address 46582, Leesburg, Commonwealth of Virginia.
Personal thoughts to my family: I wish to express my undying love to you my family, even in my death. To my husband whose love has been my source of joy in life, whose companionship I received when I had nothing to my name but a dream of better life. Should you choose to remarry, marry well – like you did with me. To my eldest child, Fredrick, you are gifted. Work hard towards your goal of becoming a medical doctor. To my youngest child, Samuel, you are a strong and competitive child. Focus in life and you shall succeed. To both my children, financial arrangements have been made to facilitate both of your educational goals.
Thank you all for the times you all laughed at my lame jokes, though they sounded really funny in my head. Lastly, love family & live life. My time has come and passed, I did it my way.
