S.22-Gun Show Background Check Act of 2013 was read twice on the Committee on the Judiciary prior to the introduction in senate on 22gd January 2013. According to the promoters, the Violence Prevention Act will stipulate the responsibilities of transferors and licenses. Any part of the firearm transaction that takes place at a gun show, each licensed importer, dealer or manufacturer that transfers a firearm to an unlicensed person has to submit a report to the Attorney General that sets forth penalties for violations. The 113th Congress grants the Attorney General with authority to investigate any gun show event in the course of business without a warrant. The attorney General can examine the inventory of the licenses and other records to determine the compliance of the Act. The Coalition to Stop Gun Violence monitors closely the gun-related legislation to educate American citizens and the lawmakers the need of enacting sensible gun laws to reduce gun-related violence in the nation.
II Problem: Name the Problem
The gun show loophole is a big issue in America. The Gun Checks Act of 2013 introduced by Representative Carolyn McCarthy requires background checks for the gun sales at any event. Senator Lautenberg introduced a companion bill S.22 Gun Show Background Check Act of 2013. Congress finds that more than 5000 guns are held annually across America. A flea market attracts the sale and purchase of a large number of firearms both licensed and unlicensed. The events allow an easy movement of firearms to affect interstate commerce. Congress also note that gun violence is a pervasive national problem exacerbated by availability of guns in the flea markets, gun shows, and any other organized event. Background checks are necessary when someone buys a firearm from the Federal Government. The people that sell guns do not have to run background checks, and this can create a loophole. A loophole can also apply to the kitchen-table sales as well as the private sales. At the gun shows, private individuals bring their collection for display and sale. Any person can walk at the gun show to a private individual selling a gun, pay for it, and carry it out of the store. It is ironic that a person needs proof identification while voting, acquiring a driving license, and accessing a job while none is required at the gun shows.
III Solution:
Prior to the commencement of a gun show, the vendor has to sign a ledger to identify information of the vendor and a notice of the vendor obligations. It is unlawful for an unlicensed person to transfer a firearm to another unlicensed person unless a firearm is transferred through a licensed importer, manufacturer, or dealer. Before the commencement of a gun show, the vendor participating in the event has to obtain a valid certificate, notice of vendor obligations, and ledger with the identifying information of the vendor.
Those that support S.22 background check procedures for gun shows since the presence of guns to the citizens that do not have licenses get their way to criminals that highly misuse them. It is important for the nation to stop guns from falling into the hands of criminals without a background check to purchase a weapon and sell it to anyone to make a profit. The country has to close all the loopholes that make the country unsafe. President Reagan said that No one needs an automatic gun for home defense, hunting, or any sporting activity.
Those that oppose the bill cite that the bill is an intrusion and an attempt to criminalize the law-abiding citizens from purchasing guns. It is also an attempt to infringe the Second Amendment. In retro respect, the gun control laws affect law-abiding citizens while allowing criminals to obtain the firearms illegally. The law should first focus on the loopholes on how criminals obtain the firearms and fix the issue.
Iv Conclusion
I maintain the support of the bill of the Gun Show Background Check since the country should not permit felons and criminals to avoid the law and purchase the firearms through backdoor dealings. The Gun Trafficking Prevention Act will mitigate the effect of interstate commerce within states’ borders
