The rule of law must forever be followed, and the freedom and rights documented in the Constitution granted. However, the United States and other parts of the world have faced some unwelcoming circumstances when these freedom and rights have to be over-ridden. After the 911 tragedy, the United States learned that its borders cannot just be opened for anyone to cross into and out. The freedom of speech must also be overridden to ensure that the internal security of the nation is maintained. I agree with the fact that some occasions call for the freedom and rights of the people to be limited. However, this should not be in any way a means of oppressing anyone. In case the general public is threatened by granting certain civil rights, then such rights can be over-ridden. At the moment, the United States is facing a massive amount of illegal immigrant influx in the country. This means that certain restrictions must be put into action to ensure that the security of the country is not compromised. This can be through discouraging such freedom as a movement. Also during the times of war or disease outbreak, it is common to have quarantines to hinder the spread of the contagious disease.
Over-ridding a civil right should not give a loophole to weaken such rights. The rule of law must always be the superior weapon in the country, and the constitution must be respected. Before over-riding a civil right, the relevant authority must provide reasons beyond any reasonable doubt why such must happen. I believe, however, that in the United States, there have been various loopholes where a civil right has been overridden for a particular occasion and later extended to another or on a certain section of the community. Surveillance on the Muslim community in the United States gives a good example of a weakening civil right. It is unfair that some Muslims have even been denied access into the United States on the basis of the 911 tragedy. This paper concludes that overriding a civil right for a specific occasion should not weaken such rights.
Having performed tolerance review, I have come up with some surprising results. To start with, I was surprised to understand that at one point or the other, the constitution can be compromised. According to what I have learned, I believed and knew that the Constitution protects everyone and that what applies to person ‘A’ applies the same way to person ‘B’ even if they are of different religions provided they are within the same territory. I had a firm position that not at one point or the other should the right and freedom of anyone be compromised. Apart from the rights and freedoms that are granted to each and every American citizen, there are civil liberties that protect the organization.
The United States has been on the frontline in the fight for human rights and freedom. In its foreign policies, the United States always stress on ensuring that the rule of law is upheld and democracy which is an aspect of right and freedom granted to all the citizens. I found out that I was not very rigid to restricting civil liberty to organizations. This result did not surprise me since I had considered a lot of factors such as the position of the United States in promoting world’s peace. I noted that the United States is always the target of many enemies such as the terrorists. Though the civil liberties support democracy, I believe that they can sometimes be compromised for the general good of the people of the United States.
The position of civil freedom in the United States is not as high as the founding fathers could have wished. I don’t think the founding fathers at one point or the other thought that the United States, once known as the free country, will ever be in such a strict surveillance where its citizens have no freedom to move and mingle with others. One of the reasons I will believe this is true is because the civil liberties were aimed towards a society which is free and no external factors considered. However, the recent misfortunes that have not only affected the United States but the world as a whole such as terrorism has led to the limitation of individual civil liberties.
According to the Fourth Amendment, the Omnibus Crime Control and Safe Streets Act of 1968 does not allow for someone to be searched without a warrant. With the changing crime tactics, it has been a challenge to identify a criminal and even to arrest one without doing a search. Going by what the founding fathers could have wished, then there could be no body searches that are nowadays witnessed in various parts of America even without a warranty. The problem is not that the police or the authority is going against the rules, but it is because of the fact of the challenges faced in maintaining domestic security. The situation is not as the same way as the founding fathers could have wished and what is to be blamed is the rate of insecurity the United States is facing.
The other reason the situation of the civil liberties is not as the founding fathers could have wished is that of technology. Unlike in the past when these rights were drafted, there was no vibrant technology as witnessed today. Technology has made it easy for people to express themselves easily without any restriction. It is important that individual civil liberties such as those promoting free speech, and expression is limited to ensure that nothing is spread over the social media that can spark an outrage or compromise the security of the United States. It can, therefore, be concluded that the position of the civil liberties in the United States is not as they could have wished and the main contributor for this being the change in the rate of crime rates and technology.
