“If you are an innocent party in a contract for an illegal purpose, should you be punished as well?” It is a difficult question. There could be one of two possibilities. First, that I know what am I dealing with. And second, I am not aware what the repercussions of the contract I am into are. But in ether of the cases, an illegal act is executed. And unfortunately, I am a part of the execution chain. This means that I must have known whether all the events following my dealings and also the end result are legal. But as a part of a contract, I may not have access to these events and in which case, getting a punishment would be surprising for me. But in the latter case, my innocence could be easily proved by the fact that I lack information.
“Do you think that minors should be able to avoid (get out of) otherwise valid contracts up until they turn 18? Even if the minor misrepresents his or her age?” The answer to this is simple. No. No one indulging in a criminal activity/illegal contract must be allowed to get out without paying a price for it. Today’s teens are going to be tomorrow’s youth. Letting them get off would nonetheless encourage them to indulge in such activities in future. Of course, the punishments need not be the same. But an action has to be taken such that it would teach them a lesson for life. Therefore, according to the contract law, all of the above must be taken into consideration so that no innocent person gets caught up in the web of lies.
