Enclosed herein is the Client Architect Agreement according to our previous discussion. Within the agreement are the definitions of the major terms, the standard services, the supplementary services, and the related conditions for the services (the client’s requirements, constraints and the limits to Architect’s responsibility) among other important factors and conditions.
Also included is the Architects Code of Professional Conduct, which is read and interpreted together with the Client Architect Agreement. Kindly read the attachment and sign the agreement.

CLIENT ARCHITECT AGREEMENT
T1 - You did not use the current AIA CAA 2009. The agreement you have provided is missing a great deal of critical information such as scope, budget, client details, etc.
Definitions
Architect – the registered “professional architect” according to the architectural act.
Budget – the anticipated value of the whole work.
Building contract – the “Principal Building Agreement” between the client and the contractor
Client – the architect’s appointing authority. In the Principal Building Agreement, it’s referred to as the employer who seeks the services of the architect.
Consultant – any other person appointed to give professional or special services other than the architect, during the course of the project.
Project – the developments for which the consultants and the architects are appointed. It is not limited to the works.
Total cost of employment – the basic salary and all other bonuses.
Works – all the work intended to be executed according to the building contract.
Standard Services
This section highlights the responsibilities of the architect
In the first stage, the architect is to receive, appraise and report on the requirements of the client according the site information, planning and budget. The architect also advises the client on the procedures for meeting the requirements, the appointment of consultants, and the contracting methods.
On the second stage, the architect advices the client on the design concepts including the intended space, planning relationships, services, and materials to be used. The advice covers the technical and functional characteristics of the proposed project; the estimated costs with respect to the budget, and the anticipated programme.
The third stage is about design development where the consult is required to develop the design concepts
The fourth stage is about technical documentation, and the final stage highlights the contract administration and inspection.
Answers to the questions
The client for this project is the company formed jointly between the parents and friends foundation and the school for which the gymnasium is to be constructed.
As the architect, I would verbally advise the client to consider the proposal that is economical and meets all the requirements. The past experience and reputation of the contractor is of utmost importance. Quality must be paid for; so, if an architect claims to be willing to meet all the costs and requirements at a very low price, then questions about the quality of work must arise.
Novation is simply a replacement of an old obligation or a contract with a new one.

The client wishes to carry out a project comprising the construction of a new school gymnasium situated at the car park.

TENDER REPORT
Introduction
The meetings, arrangement of consultants were engaged and appointed. Confirmation of the briefing as outlined before was done. Drawings were prepared and a Council approval received. There was facilitation meetings to deliberate on the drawings to make changes.
Based on the information, besides automatically accepting the lowest price, the tendering evaluation references weighting for skills, period of completion and relevance experience to ensure value for money is considered. This is done to assess the competence of the tendering organization. Tender documentation is a document describing invitation by the council to tenderers to offer a cost for delivering service contract documentation records the acceptance by the council of the tenderer’s offer that is sealed by both parties.
Overview of tenders received
Although the R & R construct tenders work within the lowest period, lack of experience which ought to have outlined relevant successful projects make it disqualified. Their past performances on time and whether they will work within the budget lacks. Rick Van Dyk’s LTD amount and construction period coupled with references make it stand a better tender but it’s a little higher expensive when compared to the available fund. The construction period is relatively long for an urgent work.
D Sams and sons works on a relatively shorter period with relatively cheaper cost making it be within the fixed budget. Their cost rhymes with the budget and have reasonable time besides having satisfactory references. SB Wright constructions fails to comply with the time tender closes. They failed to present in time tender documentation showing form of tender, pricing document and information required in the instructions to tenderers. Dean Struct Pty Ltd need for ‘cost plus’ contract is not in compliance with the outline instructions for tenderers. The amount stated is relatively lower but time taken for completion is long.
Assessment of tenders received
Tenders received were subjected to Comparative Cost of Tenders, calculated in accordance with the Instructions to tenderers. Comparisons of breakdown of Tender Totals submitted with the Pricing Document with sensitivity were analyzed based on the average for all tenders.
Conclusion and recommendation
As per the tendering process, confirmation of the tenderers who submitted the lowest comparative cost of tender, and was able to work within a shorter construction period and whose tender was submitted in accordance with the Instructions to Tenderers was D Sams and sons. Their cost was the one rhyming with the budget and they had reasonable time. They will do the work in 32 weeks and at a cost of $5, 040, 000.

Task 3a
EXTENSION OF TIME AND VARIATION FOR PROPOSED SCHOOL GYMNESIUM, CAR PARK, GROUND LEVEL
Considering the quality standards and the project requirements, time extension and variations are necessary.
Before any constructive work could be started, there was a three days delay as the alternative arrangement for car pack was being sought. Some delays also resulted from the mismatch between the survey level and the plan. The rectification claimed a total of cost of $12, 000.
Also, there was an additional work resulting from the continuous drilling in efforts of finding the strong support base, as indicated in the requirements.
The additional work at the foundation and the builder sites necessitates an extension period of seven days and an additional $85, 750; however, the builder quoted an additional $87, 500.

Task 3b
ARCHITECT’S INSTRUCTION FOR PROPOSED SCHOOL GYMNESIUM, CAR PARK, GROUND LEVEL
As the architect in charge, I must ensure that the quality of work meets client’s requirements as stated in the specification and drawings. I therefore instruct that the proprietary pads be installed under the floor joint. This instruction comes after my realization that, at some instances the sprung timber flooring lacked the pads.

Task 4
PRACTICAL COMPLETION FOR PROPOSED SCHOOL GYMNESIUM, CAR PARK, GROUND LEVEL
As per the data obtained from the site during the inspection, the project is soon to reach practical completion. The sprung timber flooring support pads still needs some fixing which may last for one week. A variation for $6,437.00 for time extension costs are to be factored in for assuming floorboard installation. The cost of rectification is however excluded from the claim. We still need the services of the builder so that the remaining building work for the project can be finished within the shortest time possible. As at now, the project is 20% incomplete and should be completed within one week.
The client should wait for just one week in order to give room for the completion of the work. This is when the certificate can be signed.
Otherwise, the work has been practically completed as per my inspection and nothing can bar the client from moving in. The Notice of Practical Completion completion and progress payment is ready for the client.
