Whereas it is true that most of the unethical practices may not be criminal or illegal in nature, I am of the opinion that there should be a structure in place to check on the run- away acts of deceptions that lead to mega financial losses. Talking about the Wall Street melt- down, for instance, some companies and individuals knowingly provided the public and investors with false information. Economic experts and investment analysts must have had a possible viable information. However, some of them decided to either withhold valuable information or misinformed their clients. If it can be established that, in any instance, the public was deceived and convinced into making investments which led to losses, then the involved persons should be prosecuted. In most cases, funds that are stolen are from low-income families who are trying to invest so as to improve their financial position. Further, it is probable that such families or individuals invest borrowed funds. Therefore, in a case of willful misinformation, then the impact would be detrimental, not only to the person who invested but to a generation of dependants.
I would suggest, therefore, that structures be put in place, whereby, such officials can be prosecuted accordingly. The primary objective of such legal structure would be to aid in the deterrence of a possible resurgence of such an act. The fact that some individuals and companies are better placed to advice unsuspecting masses should not be used as an advantage to prey on their lack of financial or investment know- how. Further, the structure should ensure that the losses incurred are recovered from such unscrupulous individuals or firms and returned to the rightful owners. This policy should be in place, even if the investors are to be charged a fee for the service.
