This law prohibits a person especially a person from flying a kite or any flying object on another person’s property without the consent of the spouse. Putting this law into action will reduce violence and lessen the rate of conflicts among neighbors who like playing with flying objects like kites. It would eliminate to possibility of conflicts. The punishment should be $ 150 for first offenders and $300 for repeat offenders with mandatory five guidance and therapy sessions.
United States v. Causby, 328 U.S. 256 (1946)
Causby sued the United States for trespassing on his property, complaining about how low-flying military helicopter caused his chicken to jump up against the walls and burst themselves open and die He was seeking compensation from a violation of his rights under the Fifth Amendment act. And argued that under the common law, he owned the whole place since the law says that real property owned it from the depths to the heavens up.
The United States Supreme Court ruled in this case that real estate tradition of owning everything from land to oil has no place in the modern world, as far as air rights are involved, but today it is treated as a source of law, or fundamental to property rights in land he was compensated since the court ruled out that the military violated the minimum safe altitude of from 500 to 1,000 feet depending on time of flight.
Application of the law
The case is useful in helping us understand the extent to which the fundamental right of a citizen is protected and the consequence of violating it.
